Change in License Renewal Requirements

 The Division of Real Estate has changed the Continuing Education Requirements for license renewal.
If your license renewal date is after January 1, 2010, your requirements will be 18 hours of
continuing education, at least 9 of which must be in CORE courses
.


 Also remember that if you received your license after July 1 of 2007, you are required to take the New
Agent Core Course during the first 2 years of your licensure.

*Between September 2010 and May 2011, 18 hours of Continuing Education Courses (including 9 hours of CORE Course) will be offered at this office on Friday mornings based on the schedule shown below. With the exception of the first course (which is four hours) each of the courses will be one hour - and will be taught between 8:30 AM and 9:30 AM.The first course on Sept 24th is a four-hour CORE course that lays the foundation for theremaining classes in this series. Everyone is strongly encouraged to attend the MASTERING THE REPC course on Sep 24th. It will run 8:30 AM to 12:30 AM.

 

 

SEP 24             MASTERING THE REPC (CORE): [NOTE: THIS IS A CORE COURSE. THERE IS A $10.00 CHARGE AT REGISTRATION FOR THIS CORE COURSE]. This is a three (3) hour CORE Course that lays the foundation for all of the courses taught between September 2010 and May 2011. Understanding and mastering the REPC is a critical skill in the professional representation of Buyer and Seller clients. This course will present detailed, practical, everyday, complicated examples of the following: clean offers, and not-so-clean ambiguous offers; counteroffers; addenda; lapsed Acceptance dates and times; problems in communicating Acceptance and withdrawal of offers; issues with personal property; included and excluded items; representations in the MLS; requests for extension of deadlines; and contingent cancellation of the REPC. This is a course that all agents should take (even if only as a refresher course), regardless of how many years in the real estate brokerage business.

 

OCT 1               STANDARD BLANK ADDENDUM FORM (CORE): [NOTE: THIS IS A CORE COURSE. THERE IS A $5.00 CHARGE AT REGISTRATION FOR THIS CORE COURSE]. When is it an “Addendum”– When is it a “Counteroffer”- What’s the difference? - Overview of the Standard Supplementary Clauses. Agents often check the “Addendum” box when the “Counteroffer” box should have been checked. This class will also take a summary look at all of the Standard Supplementary Clauses.

 

OCT 22             STANDARD SUPPLEMENTARY CLAUSES I: The previous class provided an overview of the Standard Supplementary Clauses. This class will be part one of a two part series that will take a detailed look at each of the Supplementary Clauses, and will include practical writing exercises using the following standard supplementary clauses – Subject to Sale of Buyer’s Residence/Option to Keep Property on the Market/Secondary Backup Offer

 

NOV 5              STANDARD SUPPLEMENTARY CLAUSES II: This course will continue the practical writing exercises using the following standard supplementary clauses – As-Is Addendum/Non-Occupant Addendum/Common Area Addendum/Sale Lease-Back Addendum. The course will include practical writing exercises using the following standard supplementary clauses – Third Party Approval of Property/Third Party Approval of REPC/Disclosure of Interest Addendum

 

NOV 12             PRELIMINARY TITLE REPORT VS. COMMITMENT FOR TITLE INSURANCE: What are the differences between these two documents? In Section 6 of the REPC, the seller agrees to provide the buyer with an “ALTA Homeowner’s Policy of Title Insurance”. As an agent representing the buyer or the seller, you need to be aware of this type of title policy as compared with the “standard coverage” owner’s policy. You need to be comfortable as to what to look for when reviewing a “PR” and a “Commitment for Title Insurance”. Getting a PR at the time of listing can help avoid significant problems late in the real estate transaction.

 

DEC 3               SELLER PROPERTY CONDITION DISCLOSURE: Regardless of whether your client is a buyer or a seller, this form is one of the most important documents in the entire real estate transaction. Agents should encourage buyer clients to carefully examine every statement made by the seller in this form. Agents should encourage seller clients to carefully and fully disclose everything they know about the property as prompted by the questions in this disclosure form. Agents should be fully prepared to have a thorough and professional discussion with the buyer and the seller regarding this very important disclosure form.

 

JAN 7               FOR SALE BY OWNER COMMISSION AGREEMENT: If you or   

your Buyer has located a property of interest that is “For Sale By Owner”…how do you proceed as a real estate agent/how do you get paid/what if the owner wants you to represent him as well. What if the Seller also wants you to represent the Seller - and not just the Buyer? Will this form work in that scenario. What if you are representing the Seller, another agent is representing the Buyer, but the Seller doesn't want a formal listing agreement?

 

JAN 14             EXCLUSIVE RIGHT TO SELL LISTING AGREEMENT: As a Seller’s Agent, you need to know this form inside and out. As Seller’s Agent…what are your responsibilities? What are the Seller’s responsibilities? What form do you use when the Seller wants to modify terms in the Listing Agreement?

 

FEB 4               BUYER DUE DILIGENCE CHECKLIST: Real estate is typically the    

most expensive commodity that a buyer will ever purchase. Buyers absolutely need to know all aspects of the real estate that they intend to purchase. Too few buyers conduct adequate due diligence prior to their purchase. This class focuses on the critical value of the Buyer Due Diligence Checklist. Take a very close look at this form that is designed as a tool to assist buyers in making an informed decision when purchasing real estate. Where do we draw the line between being a competent and helpful agent for our Buyer client, and doing the Buyer's Due Diligence for them?

 

MAR 4              EXCLUSIVE BUYER BROKER AGREEMENT/NON-EXCLUSIVE BUYER BROKER AGREEMENT: What are the differences in these two forms. As a Buyer’s Agent, you need to be able to provide to your client a professional explanation of each section if this form. As a Buyer’s Agent…what are your responsibilities? What are the Buyer’s responsibilities?

 

MAR 11            LIMITED AGENCY CONSENT AGREEMENT (CORE): [NOTE: THIS IS A CORE COURSE. THERE IS A $5.00 CHARGE AT REGISTRATION FOR THIS CORE COURSE]. The legal liability of acting as a “Limited Agent” is at least double that of representing only one party to the transaction. Read a court opinion involving a Limited Agent.

 

APR 8               SELLER FINANCING: Whether a Seller is willing to offer “Seller Financing” is most always dictated by the real estate market itself. In today’s market, “Seller Financing” may be an excellent means of creating a successful real estate transaction. This 1-hour course looks carefully at the standard form Seller Financing Addendum. This class is a must in today’s market.

 

APR 22             MAHLER VS. KEENAN REAL ESTATE (COURT CASES I): (CORE) [NOTE: THIS IS A CORE COURSE. THERE IS A $5.00 CHARGE AT REGISTRATION FOR THIS CORE COURSE]. In this course, you will have the opportunity to read through an actual court opinion involving a claim against a real estate agent for failure to adequately disclose defects in the property. This is a very important case and illustrates the importance of full disclosure by the owner of the property

 

MAY 6              COURT CASES II: (CORE) [NOTE: THIS IS A CORE COURSE. THERE IS A $5.00 CHARGE AT REGISTRATION FOR THIS CORE COURSE]. This course will continue the review of actual court opinions involving lawsuits against real estate agents. Each of these cases looks at the allegations of breach of contract, misrepresentation, breach of fiduciary duty, and negligence by the real estate agent. The course will also focus on measures that could have been taken by the real estate agent(s) to avoid the lawsuit in the first place.

 

MAY 13            UTAH DIV OF REAL ESTATE - ADMINISTRATIVE RULES II (CORE): [NOTE: THIS IS A CORE COURSE. THERE IS A $5.00 CHARGE AT REGISTRATION FOR THIS CORE COURSE]. This course takes a detailed look at the legal requirements associated with advertising real estate and your services as a real estate agent. It’s one            

thing to be artistically creative and interesting; it’s another thing to mislead the public.
